How can you find what you are searching for when you may not know what you are searching for at the onset. Thorough and accurate research will allow your research to develop over time. Legal research is multifaceted in that it is both process and outcome.
It is the process of legal research that leads you to what you need to find in order to solve a legal dispute and/or determine the correct application of laws and rules for a set of facts.
The outcome of legal research is to ensure that thorough research has resulted in finding the rules, laws, and evidence to support or dispute a set of facts. Oftentimes when conducting research more information may be found in order to further develop a fact pattern. When your research leads you to another outcome it is important to not just stick to the original conclusion that was being drawn, but to include the new outcome as well.
The purpose of this course is to acquaint students with the fundamentals of legal research. Students will learn to use and locate primary and secondary authorities. The course will include a general overview of the U.S. federal, U.S. state, and Native American court systems.
